1. Cadman Wine – Who we are and how to Contact us

2. Minimum Order

There is no minimum order for shopping with Cadman Wine.

3. Prices And Payment

3.1 All delivery retail prices are quoted in Pounds Sterling, inclusive of VAT and Excise Duty. Requisite delivery charges are additional in accordance with our delivery policy.

3.2 All in bond prices are quoted in Pounds Sterling without any VAT or Excise Duty. VAT and Duty are applicable at the time of withdrawing from a bonded warehouse.

3.3 We accept payment by Maestro, Visa, MasterCard and American Express. We also accept a variety of Crypto Currencies charged at the prevailing exchange rate.

3.4 Any discounts offered are based on prices that have been previously advertised on our website. Discounted products will have been available at their previously advertised price for at least 28 consecutive days in the previous 6 months.

4. Delivery & Insurance

4.1 Orders in the UK will be delivered to a single address and charged in accordance with the charges quoted on our delivery information page. You agree that we may use independent third parties to deliver the wines.

4.2 We can deliver to & accept orders from the Channel Islands & overseas. Please contact us for the current relevant charges that maybe applicable. Any import related costs incurred shipping internationally are the responsibility of the client. 

4.3 We aim to deliver within 5 working days or less to UK mainland unless stated otherwise (e.g. En Primeur wines are sold with a longer lead time). Non-UK mainland deliveries will likely take longer. However, we are grateful for your understanding that in exceptional circumstances beyond our control delivery may take longer. While every effort is made to dispatch your orders within a few days of acceptance, please allow up to 30 days for delivery. In such cases, we will attempt to notify you and Cadman Wine reserves the right to dispatch the order within a reasonable period of the occurrence of such delay.

5. Substitutions

We cannot guarantee the availability of all the products we advertise. In the event that a wine becomes unavailable we will contact to advise a suitable replacement.

6. Cooling Off Period And Customer Guarantee

6.1 You are entitled to cancel your order, by contacting Cadman Wine using the contact details provided at the beginning of this document, for a period of 14 working days from delivery to you. 

6.2 The additional customer guarantee provided in Clause 6.1 above is intended for the benefit of all our customers. However, if we believe that a customer has abused this guarantee, we may decide to withdraw the benefit of the customer guarantee from that customer. Alternatively, we reserve the right to close that or any other account of the Customer without notice and/or refuse to accept any further orders from that customer. In these circumstances, our decision will be final.

7. Refunds and Returns

7.1 Refunds for returned bottles will be organised immediately on receipt of the wine(s) at our warehouse providing they remain in saleable condition. Returned wines which are deemed not to be saleable cannot be refunded and will result in redelivery.

7.2 Refunds for wines deemed to be out of condition or not suitable will be dealt with on a case-by-case basis.

7.3 We will process any agreed refunds within 14 calendar days of receiving the wine back. Please be aware that any refunds to a credit card will be processed immediately by us but may take between 3 – 10 days to appear on your statement. However, we reserve the right to deduct from the amount refunded the cost of returning the wine to Cadman Wine.

8. Fine and Rare Wines

8.1 Cadman Wine is committed to providing our customers with an exceptional level of service. All fine and rare bottles are stored professionally whether in bond or duty paid.

8.2 In many instances, an accurate condition report can be presented for such wines on our website. Purchasers of fine and rare, or older bottles of wine must take into account natural variations in fill and the conditions of the label, cork and wine.

8.3 Please note that a refund or credit will only be offered at our complete discretion in the event of a corked or oxidised wine, and that we reserve the right to request the return of any suspect bottle in order to verify its condition.

8.4 We are unable to accept responsibility for the condition of wines purchased by us in good faith, where the contents of the bottle does not correspond to the drinking experience implied by its description and/or professional review.

8.5 If, on delivery, a product does not meet with your complete satisfaction, please inform us within 14 days of receipt, and we will organise to have it collected. A refund will be issued subject to the product remaining in a saleable condition, in its original, undamaged packaging where applicable. 

9. En Primeur And Pre-Shipment

9.1 Products sold En Primeur will be sold without any Excise Duty, VAT or Transport Costs. These costs will be invoiced accordingly upon organising delivery of the wines.

9.2 Products sold as Pre-Shipment can be sold either in bond or retail (inclusive of VAT and Excise Duty). The status of the sale will be made clear at the outset.

9.3 Cancellation of En Primeur and Pre-Shipment sales will be dealt with on a case-by-case basis.

10. Age Restriction

10.1 By placing an order you are confirming that you, and the intended recipient, are 18 years of age or over. We cannot sell wine to, or intended for, anyone who is under 18. You may be asked to provide proof of age prior to delivery.

10.2 If you are buying wine as a gift the recipient must also be 18 years of age or older.

11. Vouchers

11.1 Should you receive a voucher to redeem against the purchase of wine from us you agree to be bound the terms and conditions on that voucher.

11.2 Vouchers are not transferable and may not be sold or auctioned.

12. Force Majeure

12.1 The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond our reasonable control.

13. Bin End Sale & Other Clearance Sales

13.1 In the case of clearance sales, items are offered at no further discount.

13.2 You are entitled to cancel your order, by contacting Cadman Wine using the contact details provided in Clause 1 above, for a period of 14 working days from delivery to you. After this period has expired, we cannot accept returns of clearance sale items, other than in instances where the wine is actually faulty (i.e.: ‘corked’) or broken. On this occasion the additional customer guarantee provided in Clause 6.1 above does not apply, however this does not affect your statutory rights.

14. Data Protection and Privacy Policy

14.1 Cadman Wine is committed to preserving the privacy of all visitors to its website. By registering, visiting or placing an order with Cadman Wine, you consent to the collection, holding, use and transfer of certain information about yourself and your usage of (and communications with) this website and our telephone ordering system, in accordance with these terms and conditions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

14.2 Our full Privacy Policy is listed on the Privacy Policy page on our website.

15. Warranty; Limitation on Liability

15.1 We warrant that the wines will be of satisfactory quality and fit for their general purpose, but make no other warranty with respect to the wines except as required by law and as set out in Clause 6 and Clause 11.

15.2 Nothing in these Terms and Conditions shall exclude our liability for personal injury or death caused by our negligence.

15.3 We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where such loss or damage: “was not foreseeable to both us and you when the contract was formed”; was not caused by any breach on our part”; and/or “relates to business and/or non-consumers”.

15.4 Subject to Clause 13.2 above we will not be liable for loss or damage caused by your handling the wine. In particular we will not be liable for spillages or breakages.

15.5 Customers should also be aware of the following inherent risks and warnings: ” Alcohol should be consumed in moderation. ” A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time. ” Sparkling wines and champagnes can be volatile due to the build up of gasses so extra care should be taken when opening these.

16. Changes to these terms and conditions

16.1 We may amend these terms and conditions from time to time without notice.

17. Governing Law and Jurisdiction and codes of conduct

17.1 These terms and conditions and the relationship between Cadman Wine and you shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales over any claim or matter arising under or in connection with these terms and conditions or the legal relationship established between you and Cadman Wine .

17.2 There are no codes of conduct applicable to any contract between Cadman Wine and you.
